  • You retain ownership of any content (audio, video, text, etc.) you upload (“User Content”).

  • By uploading User Content, you grant us a limited license to process, store, and generate output as required to provide the Services.

  • You are solely responsible for ensuring you have the rights to the User Content you upload.

4. Acceptable Use

You agree not to use the Services for:

  • Illegal, infringing, or harmful purposes.

  • Uploading or generating content that is abusive, hateful, obscene, defamatory, or violates intellectual property rights.

  • Reverse engineering, copying, or reselling our Services without permission.

5. Subscription & Payments

  • Access to premium features requires a paid monthly subscription.

  • Subscriptions are billed monthly in advance and will automatically renew each month unless canceled before the next billing cycle.

  • By subscribing, you authorize Kalakar.io to automatically charge your provided payment method each month until you cancel.

  • You are responsible for applicable taxes and charges depending on your location.

  • All payments to Kalakar.io are final and non-refundable.

  • No refunds or credits will be issued, including for:

    • Partial use of the Service

    • Dissatisfaction with the Service

    • Cancellation after billing

    • Accidentally choosing a different or incorrect subscription plan

  • We may suspend, discontinue, or modify any part of the Services at any time.

  • Clanflare Solutions Pvt. Ltd. is responsible for billing, invoicing, and taxation related to UPI transactions.

  • The software and all related services are provided solely by Editing Skool LLC, the developer and owner of Kalakar.io.

  • Card payments, international payments, and all non-UPI transactions are handled by Stripe, which acts as the payment processor for such transactions.

14. Taxation Clarification

  • Kalakar.io is owned and operated by Editing Skool LLC, a company registered in the State of Wyoming, USA.

  • In accordance with applicable tax laws of Wyoming and the United States, Editing Skool LLC will remit taxes within the United States.

  • Taxes collected through UPI transactions in India are handled and remitted by Clanflare Solutions Pvt. Ltd., as per Indian tax regulations.

15. Product Responsibility Clause

  • Editing Skool LLC is solely responsible for the development, functionality, support, and maintenance of the Kalakar.io software and all associated products or services.

  • Clanflare Solutions Pvt. Ltd. is responsible only for UPI-related billing, invoicing, and taxation.

  • All UPI-related billing and taxation matters shall be governed by the laws of India, while all product-related matters shall be governed by the laws of the United States.

16. Data Controller / Data Processor Clarification

  • Editing Skool LLC is the Data Controller and retains ownership of all customer and user data collected through Kalakar.io.

  • Clanflare Solutions Pvt. Ltd. acts solely as a Data Processor for the limited purpose of handling UPI billing information.

  • Clanflare does not have access to user content, captions, or personal data beyond what is required for UPI payment processing.

3. User Content

  • You retain ownership of any content (audio, video, text, etc.) you upload (“User Content”).

  • By uploading User Content, you grant us a limited license to process, store, and generate output as required to provide the Services.

  • You are solely responsible for ensuring you have the rights to the User Content you upload.

4. Acceptable Use

You agree not to use the Services for:

  • Illegal, infringing, or harmful purposes.

  • Uploading or generating content that is abusive, hateful, obscene, defamatory, or violates intellectual property rights.

  • Reverse engineering, copying, or reselling our Services without permission.

5. Subscription & Payments

  • Access to premium features requires a paid monthly subscription.

  • Subscriptions are billed monthly in advance and will automatically renew each month unless canceled before the next billing cycle.

  • By subscribing, you authorize Kalakar.io to automatically charge your provided payment method each month until you cancel.

  • You are responsible for applicable taxes and charges depending on your location.

6. Refund Policy

  • All payments to Kalakar.io are final and non-refundable.

  • No refunds or credits will be issued, including for:

    • Partial use of the Service

    • Dissatisfaction with the Service

    • Cancellation after billing

    • Accidentally choosing a different or incorrect subscription plan

  • Please review your subscription plan carefully before confirming payment.

7. Service Changes & Termination

  • We may suspend, discontinue, or modify any part of the Services at any time.

  • We may terminate or suspend your account if you violate these Terms.

  • Upon termination, your access to Services and any stored data may be deleted or restricted.

8. Data & Privacy

  • We take reasonable measures to protect your User Content and data.

  • We may use trusted third-party service providers (“subprocessors”) to support delivery of our Services.

  • We do not claim ownership over your data, but you grant us rights to process it solely for providing the Services.

9. Intellectual Property

  • Kalakar.io, including its software, features, designs, and branding, are our property and protected by applicable intellectual property rights.

  • Except for the limited license granted, nothing in these Terms transfers any ownership to you.

10. Disclaimers

  • Services are provided “as is” and “as available” without warranties of any kind.

  • We do not guarantee uninterrupted or error-free service, or that results will meet your expectations.

11. Limitation of Liability

  • To the maximum extent permitted, our liability is limited to the amount you paid us in the last 12 months.

  • We are not liable for indirect, incidental, or consequential damages including data loss, business interruption, or lost profits.

12. Changes to Terms

We may revise these Terms at any time. Continued use of our Services after changes means you accept the updated Terms.

13. Merchant of Record Disclosure

  • Clanflare Solutions Pvt. Ltd. acts as the official Merchant of Record (MOR) and authorized reseller for customers located in India.

  • This applies only to payments made through UPI (Unified Payments Interface).

  • Clanflare Solutions Pvt. Ltd. is responsible for billing, invoicing, and taxation related to UPI transactions.

  • The software and all related services are provided solely by Editing Skool LLC, the developer and owner of Kalakar.io.

  • Card payments, international payments, and all non-UPI transactions are handled by Stripe, which acts as the payment processor for such transactions.

14. Taxation Clarification

  • Kalakar.io is owned and operated by Editing Skool LLC, a company registered in the State of Wyoming, USA.

  • In accordance with applicable tax laws of Wyoming and the United States, Editing Skool LLC will remit taxes within the United States.

  • Taxes collected through UPI transactions in India are handled and remitted by Clanflare Solutions Pvt. Ltd., as per Indian tax regulations.

15. Product Responsibility Clause

  • Editing Skool LLC is solely responsible for the development, functionality, support, and maintenance of the Kalakar.io software and all associated products or services.

  • Clanflare Solutions Pvt. Ltd. is responsible only for UPI-related billing, invoicing, and taxation.

  • All UPI-related billing and taxation matters shall be governed by the laws of India, while all product-related matters shall be governed by the laws of the United States.

16. Data Controller / Data Processor Clarification

  • Editing Skool LLC is the Data Controller and retains ownership of all customer and user data collected through Kalakar.io.

  • Clanflare Solutions Pvt. Ltd. acts solely as a Data Processor for the limited purpose of handling UPI billing information.

  • Clanflare does not have access to user content, captions, or personal data beyond what is required for UPI payment processing.


2. Customer Grievance Redressal Policy

At Kalakar.io, we value customer satisfaction and are committed to resolving grievances quickly and transparently.

How to Raise a Complaint

Acknowledgment

  • All complaints will be acknowledged within 24–48 hours.

  • A reference number will be provided for tracking.

Resolution Timeline

  • Simple issues: within 3 working days.

  • Complex issues: within 7–14 working days.

  • If more time is required, customers will be informed with an updated timeline.

Escalation

If unresolved, complaints will be escalated internally to our Grievance Officer for review and resolution.

Record Keeping

All grievances are logged and reviewed regularly to improve our Services.

3. Refund & Dispute Policy

Refund Policy

  • Kalakar.io does not provide refunds under any circumstances.

  • All subscription payments, renewals, upgrades, or one-time purchases are final and non-refundable.

  • We do not issue refunds, credits, or exchanges even if:

    • You discontinue the service

    • You are unsatisfied with the captions or features

    • You only used it for a short period

    • You accidentally select a different or incorrect subscription plan

    • You subscribe to the wrong plan by mistake

  • It is your responsibility to carefully review your subscription before confirming payment.

  • Monthly subscription charges will continue automatically until canceled by the user.

  • Refund-related disputes or requests will not be entertained or processed.
